Minutes
Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Red Lake Falls, Red Lake County, Minnesota was duly held in the Council Chambers of said City on the 22nd day of August, 2016.
Members Present: Kevin Harmoning, Allen Bertilrud, Neil Knaack, Kevin Brevik, Cheryl Matzke, Sara Kenfield
Members Absent: none
Others Present: Kathy Schmitz, Delray Sparby, Mitch Bernstein, Joel Paulsen, Carol Seeger, Deb Derouin
The Public Hearing for the Opt-Out Ordinance pertaining to Temporary Family Healthcare Dwellings was held at 6:30 prior to this council meeting.
Mayor Kevin Harmoning called the meeting to order at 6:42 p.m.
Bertilrud moved, seconded by Matzke, to approve the Agenda with the addition of Code of Ordinances under 7.4 Miscellaneous. MOTION CARRIED UNANIMOUSLY
Brevik moved, seconded by Knaack, to approve the August 8, 2016 City Council Meeting minutes with two typo corrections on page 2 and page 4. MOTION CARRIED UNANIMOUSLY
Bertilrud moved, seconded by Knaack, to approve the August 8, 2016 Public Hearing minutes. MOTION CARRIED UNANIMOUSLY
Harmoning moved, seconded by Brevik, to accept the 3-year agreement between the City and the Blue Line Club for a 3% increase for each of the years for 3 years and $2,500 per year for Open Skating for 3 years. Abstain: Sara Kenfield. MOTION CARRIED
Kenfield moved, seconded by Bertilrud, to approve giving a $5,000 increase in Administrator Schmitz’s salary plus 5 more compensatory days (for a total of 10) to be used at her will, effective January 1, 2017. This offer also includes her benefit package. MOTION CARRIED UNANIMOUSLY
Bertilrud moved, seconded by Kenfield, to increase the health insurance portion that the City pays for employees to $778 per month ($653 for the premium and $125 for the Health Savings Account-HSA) effective January 1, 2017. Opposed: Brevik, Knaack (not many employers foot whole insurance bill). MOTION CARRIED

Harmoning moved, seconded by Matzke, to issue a Temporary Certificate of Occupancy to Dollar General with a 45-day window of opportunity to relocate the storm sewer and they must comply with the construction plan of the City Engineer and approval by the City Attorney afterwards in order to get the Certificate of Occupancy. Opposed: Knaack. MOTION CARRIED
Bertilrud moved, seconded by Matzke, to table Brad Johnson’s archery request until we see what the archery ordinance is in other cities. MOTION CARRIED UNANIMOUSLY
Brevik moved, seconded by Matzke, to deny approval of payment for the two bills from Wilcox Plumbing totaling $514.51. MOTION CARRIED UNANIMOUSLY

Business:
In order for the City to opt-out of the requirements of Minnesota Statutes, Section 462.3593 which defines and regulates Temporary Family Healthcare Dwellings, the opt-out ordinance must be passed and published by September 1, 2016.
Kenfield moved, seconded by Matzke, to hold a first reading of Ordinance No. 905.03.02 amending city code by adopting a section opting-out of the requirements of Minnesota Statutes, Section 462.3593. MOTION CARRIED UNANIMOUSLY
Bertilrud moved, seconded by Brevik, to approve Ordinance No. 905.03.02 and that we waive additional readings due to time constraints and authorize Vice Mayor Kenfield to sign the ordinance. Abstain: Harmoning. MOTION CARRIED
Deb Derouin, Red Lake County Insurance, handed out the insurance renewal quotations for the property, general liability, excess liability and worker’s compensation for next year. Total cost for insurance in 2015 was $62,027 and the 2016 renewal offer is $64,316. The 2016 policy term dividend check was $13,016. She needs a motion from the council for the liability coverage waiver form (in the event of a tort). Agent Derouin explained the city policies and what is covered, the premium costs and answered questions from the council.
Bertilrud moved, seconded by Matzke, to not waive the statutory limits as set by the State of Minnesota for tort liability. MOTION CARRIED UNANIMOUSLY
Matzke moved, seconded by Knaack, to approve the Red Lake County Insurance 2016 renewal quote of $64,316. MOTION CARRIED UNANIMOUSLY
Mayor Harmoning verified approval of Bills and Finance Checks #039442-#039468, Payroll Checks #005081 – #005085 + Payroll E Checks 1- 21.

Kenfield moved, seconded by Bertilrud, to approve the Bills and Finance Checks #039469 – #039509, Payroll Checks #005086 – #005087 + Payroll E Checks 1 – 16. MOTION CARRIED UNANIMOUSLY
The council meeting adjourned at 9:05 p.m.
